1. Acceptance of Terms

By accessing or using BioForge ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and A-X Software, operator of BioForge. We reserve the right to update these Terms at any time. We will notify you of material changes by posting a notice on the platform. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Account Terms

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account and credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 16 years old to use the Service. If you are under 18, you must have parental or guardian consent.
• One person or legal entity may not maintain more than one account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Upload data belonging to another person without their explicit consent.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any aspect of the Service.
• Use the Service to build a competing product or service.
• Scrape, crawl, or use automated means to access the Service without our written permission.
• Upload malicious code, viruses, or any content designed to harm the Service.

5. Your Data

You retain ownership of all data you upload to BioForge. By uploading data, you grant us a limited license to process it solely for the purpose of providing the Service to you.

We will not use your data for any purpose other than providing and improving the Service. We will not sell your data to third parties. We will not use your data for advertising.

You may export or delete your data at any time. For details on how we handle your data, please refer to our Privacy Policy.

6. Intellectual Property

The Service, including its software, design, content, documentation, and branding, is the intellectual property of BioForge and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, distribute, or create derivative works based on the Service.

7. Third-Party Integrations

The Service integrates with third-party platforms (e.g., Garmin Connect, Intervals.icu). Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BioForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, whether in contract, tort, or otherwise, arising from your use of or inability to use the Service.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, or non-infringement.

9. Indemnification

You agree to indemnify and hold harmless BioForge, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. You may request export of your data before termination. We will retain your data for up to 30 days after termination to allow for data export, after which it will be permanently deleted.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts. Nothing in these Terms shall affect your statutory rights as a consumer under applicable EU law.

12. Dispute Resolution

We encourage you to contact us first at support@bioforge.science to resolve any disputes informally. If a dispute cannot be resolved informally, it shall be submitted to the competent courts as specified above.

EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may modify these Terms at any time. We will provide reasonable notice of material changes through the Service or by email. If you disagree with the modified Terms, you may terminate your account. Continued use of the Service after notice constitutes acceptance of the modified Terms.
